弁理士の国家試験に合格し、弁理士会へ登録する必要がある。この試験は学歴に関係なく受験することができるが、現在活躍している弁理士のほとんどが大学卒業者であり、理工系出身者が大半を占めている。
弁理士試験に合格する他、特許庁において、通算7年以上審判官又は審査官として、審判又は審査の事務に従事した者、又は、弁護士法により弁護士と認められる者も弁理士になれる資格がある。
上記資格に該当し、経済産業大臣又は大臣から指定を受けた機関が実施する、弁理士法に定められた実務修習を経て初めて弁理士登録をすることができる。
特許事務所や企業の知的財産部門に数年間勤務し、経験を積んでから独立するケースが多い。
仕事を通して、知的財産権を中心とする法律などの諸問題に精通することが求められる。特定の技術分野を専門とする人は、電気、機械、化学等、それぞれの分野の最先端技術の知識が必要となる。また、国際的にも知的財産権を巡っての競争や紛争は激しさを増しており、外国への出願、外国から日本への出願も多く、外国の弁理士と提携して仕事をすることもあり、英語をはじめ外国語の能力も必要とされる。
